A clearance search is often conducted to determine whether a particular trade name, a brand name or a trademark is available for adoption and proposed use. Many companies may unknowingly adopt a trade name, a brand name or trademark (collectively, “trademark”) that is already being used by another. This can render the companies vulnerable to a lawsuit and can limit the company’s ability to use its trademark later. The best approach is to exercise due diligence by performing a clearance search before adopting and using a trademark as well as filing a trademark application for the mark.
